General terms and conditions of business

1. Scope of validity
   The following general terms and conditions of business (GTC) in the version valid at the time of your order are applicable for all business relations between the purchaser and DermaVit GmbH & Co KG.
2. Conclusion of Contract
   In general, the order is placed online (after accepting the general terms and conditions)or by sending the completed order form by e-mail or fax, or by telephone. The contract is binding with the delivery of the order. If a product should not be in stock, we will inform the purchaser of the latest date he/she can expect delivery and reimburse any previous payment (credit note) if necessary. By providing the delivery address, the purchaser guarantees receipt of the order at the address given.
3. Prices
   Prices stated at the time of ordering are valid.
   All prices include VAT. See additional cost for shipping.
4. Delivery
   With delivery of the goods ex-warehouse we will have fulfilled our liability, and performance and price risk devolve on the purchaser. We reserve the right to make partial deliveries. Stated delivery periods are benchmark guidelines. Goods delivered to the address given by the purchaser are to be accepted by the purchaser even if they are damaged. Should the purchaser not accept the goods, we reserve the right to withdraw from the contract after a waiting period of an additional two weeks or to demand compensation due to breach of contract.
5. Payment
   The purchase price is due within 14 days of receipt of the invoice. Default of payment occurs if we have not received payment 20 days after delivery. The purchaser will then receive a demand note invoicing an additional EUR 5.00. For default of payment we are legally entitled to default interest at a rate of one percent of the invoice amount per month. Should we be able to prove higher damage caused by default we are entitled to claim for this. On his/her part the purchaser can cite such demands that are undisputed on our part or that have been ascertained as legally binding.
6. Retention of ownership
   We retain ownership of goods delivered by us until all accounts receivable have been paid.
7. Warranty and Liability
   The warranty period is one year from the date of delivery.
8. Data Privacy
   We (DermaVit GmbH & Co KG)commit ourselves to protecting and respecting your privacy when visiting our website. Any personal data that you provide to us, or that we may collect as a result of visiting www.derma-vit.com, will be handled with care and according to the obligation to observe confidentiality. 9. Applicable Law
   The contract is subject to German law.
10. Cancellation policy
    According to § 312d BGB, the purchaser is entitled to cancel the order within two weeks of receiving the goods. All goods purchased from us can be returned within 30 days with full reimbursement of your purchase price as long as the goods are unused. In order to guarantee high quality and customer satisfaction, we would ask you to inform us of the reason for your return. We will of course reimburse the shipping costs also if the goods have reached you in a damaged condition or show other faults. We thank you for your understanding that in all other cases the shipping charges are to be carried by the purchaser: in particular if the goods have not been returned to us within 14 days (but still within the 30-day limit) and the contract was not cancelled within the 14-day period.
